Musharraf’s legal team wants high treason case hearing in Karachi

ISLAMABAD, (SANA): Former dictator general (retd) Pervaiz Musharraf’s counsel in high treason case during the hearing of case before Special Court on Tuesday requested the court that in view of the 14th August long march call either to shift the venue of the court to Karachi or adjourned in till August 16. However turned down his request and it would see the matter on Wednesday.

Former President Pervez Musharraf counsels cross-examined Khalid Rasool deputy director FIA. The court has summoned the seventh prosecution witness Maqsood ul Hassan FIA Director for recording his statement and cross-questions today (Wednesday). The prosecution also informed the court that head of investigation team Hussain Asghar would not be presented before the Special Court as witnesses.

A three-judge Special Court presided over by Justice Faisal Arab and comprising Justice Tahira Safdar and Justice Yawar Ali Khan heard high treason case against former army chief general retired Pervez Musharraf.

Khalid Rasool, on the query of the defence counsel, informed the court that following the direction of the FIA investigative team he only assisted the team members in collecting the documents from various departments. He told that he did not conduct any inquiry, adding besides him FIA officers Khalid Naeem and Shahzad Zafar also assisted the FIA team.

He said they had visited Cabinet Division, Law Ministry and Pakistan Television headquarters to collect the relevant documents. He informed that he was unaware on what date the investigative team completed inquiry and submitted the report in the court, but according to the documents the investigations were completed on 16th November 2013.

On the question of Farogh Naseem the deputy director FIA said that it was true that once the inquiry is complete then to reopen the permission from the relevant authority is must. He neither had any written approval nor have any direction in this regard, Khalid Rasool replied.

He told he was not aware whether any case was registered against Pervez Musharraf, adding whatever assigned to him he completed that task because his job was to collect the documents from various departments and in that regard investigative team officers Khalid Qureshi and Mehmood-ul-Hassan gave him verbal orders and he acted upon them.

Farogh Naseem questioned him when the FIA investigative team had completed its inquiry on 11th December 2013 then on what authority he had collected the documents from various departments on December 18, 2013. Khalid Rasool replied he had visited the departments on the verbal orders of the relevant officers.

He said neither he was aware in which FIA circle or police station an FIR against Pervez Musharraf had been registered nor he has any registration number.

Upon that Farogh Naseem addressing the court said he did not know under what FIA rules the case not registered against Pervez Musharraf in the police station.

He informed the court that before becoming member of the FIA investigative team he had not examined the documents, and not doing that he had committed any illegal act and whatever task had been assigned to him he completed that. “I did not take any decision of his own,” the FIA deputy director replied.

Farogh Naseem contended that Khalid Qureshi was not empower to authorize any one for collection of the documents from relevant departments. However, Khalid Rasood stated that whatever the steps he had on the directions of Khalid Qureshi were legal.

The defence counsel objected that the DVD presented before the court it scripted need to authenticated, because Talib Hussain, PTV producer, who had submitted the DVD was not presented when the Pervez Musharraf’s 3rd November 2007 speech was recorded.

Meanwhile prosecutor Akram Sheikh raised several objections during the hearing of case and said that the copy of script of Pervaiz Musharraf’s speech for proclamation of emergency on November 03, 2007 should be given to defence, prosecution and witnesses as well.

The court recorded objections raised by Akram Sheikh after that defence and prosecution submitted their written applications in the court regarding the provision of script of Musharraf’s speech.

Farogh Naseem insisted that court may record statement of Khalid Qureshi the head of FIA’s investigation team and after that he would seek a week long adjournment for preparation of cross-examining his statement but prosecutor Akram Sheikh said that court may record the statement of Maqssod ul Hassan.

Farogh Naseem was of the view that a long march call also has been given by the political parties on 14 August, so court may transfer the hearing of to Karachi or may adjourn further hearing till August 16.

Later the court said that it would decide in this regard after recording statement of 7 th prosecution witness and adjourned the hearing of case till today (Wednesday).
