IHC can hear petitions filed under article 199: Justice Athar

ISLAMABAD, (SANA): A judge of Islamabad High Court (IHC) Justice Athar Minallah has observed that the IHC can hear petitions regarding human rights filed under article 199 of the constitution, adding that the court can hear the petition against imposition of article 245 in Islamabad by the federal government.

During the course of hearing the court summoned additional attorney general and other senior lawyers of the court for taking their stance on the issue.

Additional Attorney General presenting the notification informed the court that Chief Commissioner Islamabad has called Army under article 245.

The court observed that the reasons for summoning the army have not been mentioned in the notification.

Justice Athar was of the view that the IHC has powers to hear the petitions filed under article 199, adding that the court can not block the way of provision of justice to masses. The courts always decide their jurisdiction and government can not reduce the powers of courts by issuing a notification.

The court has disposed of the petitions filed for the decision over the jurisdiction of the court for hearing of the case filed under article 199 of the constitution.
